APPLICANT REQUESTS THAT:
Her 17 Aug 12 Fitness Assessment (FA) be declared void and removed from the Air Force Fitness Management System (AFFMS).

APPLICANT CONTENDS THAT:
Her Physical Training Leader (PTL) assessed her unfairly during her FA. The PTL measured her abdominal circumference (AC) at 33 inches, while six months earlier she weighed the same amount and was measured at 29 inches. When she asked to be remeasured, the Fitness Assessment Center (FAC) representative measured her AC at 31.5 inches, causing the PTL to become clearly upset. Then, during the push-up portion of the FA when the applicants push-up partner had counted seven of her push-ups, the PTL stopped her partner from counting and continued to tell the applicant to go lower until the allotted time for push-ups was over, and then only counted seven of her total push-ups. Her push-up partner said I would have counted your push-ups.

The applicant served in the Regular Air Force in the grade of Senior Airman (E-4) during the matter under review.

* The applicant scored enough composite points during the 17 Aug 12 FA to pass; however, she received an unsatisfactory rating because she failed to complete the minimum number or push-ups.

AIR FORCE EVALUATION:
AFPC/DPSIM recommends denial indicating there is no evidence of an error or injustice. The applicant did not provide any documentation to support her claim. Without documentation to support her claim, DPSIM cannot determine whether or not there was an error or injustice.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on 22 Mar 13 for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit D).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicants complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the relief.

The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.

This logic also concludes a medical condition causing weight gain would cause an increase in AC. She should have never taken the walk test while her dosage was still being adjusted and the FA should be invalidated based on the solid medical evidence presented. While we note the applicant requests the entire FA dated 25 Apr 2012, be removed, the AF Form 422 reflected that she was cleared to test using AC and she has not provided substantial evidence to persuade us otherwise.
